These Terms of Service (“Terms”) govern your use of the services provided by Aspire to Grow Ltd, trading as Tendle (“we,” “us,” or “our”). By using our services, you agree to be bound by these Terms.
1. Services Provided
Tendle offers bid and tender writing, selection, and review services designed to help small businesses compete for contract opportunities. We provide expert support tailored to your business needs.
2. Service Agreement
- Upon engaging with us, we will provide a service agreement outlining the scope, fees, and terms specific to your project.
- Services commence once the agreement is signed or otherwise accepted.
- We reserve the right to refuse service at our discretion.
3. Fees and Payment
- Our pricing includes a daily rate and a success-based fee payable only if your bid wins.
- Payment terms, invoicing, and methods will be detailed in your service agreement.
- Late payments may incur interest or suspension of services until resolved.
4. Client Responsibilities
- You agree to provide accurate, complete, and timely information required for bid preparation.
- You are responsible for reviewing all final submissions before they are sent to third parties.
- You must comply with all relevant laws and regulations related to your bids and contracts.
5. Confidentiality
- We treat all client information as confidential and will not disclose it to third parties except as necessary to deliver services or as required by law.
- You agree to keep any proprietary information shared by Tendle confidential.
6. Intellectual Property
- All materials, documents, and content created by Tendle during the provision of services remain our intellectual property until full payment is received.
- Upon full payment, you are granted a license to use the delivered work solely for the purposes agreed in the service contract.
7. Limitation of Liability
- Tendle will use reasonable skill and care in providing services but does not guarantee any specific outcome or contract award.
- We are not liable for any indirect, incidental, or consequential damages arising from the use of our services.
- Our total liability to you for any claim related to our services shall not exceed the fees paid by you to us for those services.
8. Termination
- Either party may terminate the service agreement with written notice.
- Upon termination, you agree to pay for all services rendered up to the termination date.
- We may suspend or terminate services immediately for breach of these Terms.
9. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts in England.
10. Changes to Terms
We may update these Terms from time to time. Changes will be communicated to you, and continued use of our services constitutes acceptance of the updated Terms.
